PropFinder is a property data analytics website (the “Platform”) that uses historical data to perform algorithmic projections based on search criteria submitted by you. We offer this Platform and all products available from this Platform to you for either personal or business use, on the condition that you accept all the following terms and conditions (the “Terms”).

Your access to and use of the Platform is conditional on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Platform. By accessing or using the Platform you agree to be bound by these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM ACCESSING THE PLATFORM AND MUST DISCONTINUE USE IMMEDIATELY.

The terms “we”, “us”, or “our” refer to InvestIn Global Pty Ltd trading as PropFinder. The terms “you” and “your” mean the individual or entity exercising the rights granted under these Terms.

Products

The content contained in the Platform is made available for purchase or download as various products (each a ‘Product’), including reports containing aggregated suburb level information, algorithmic projections based on historical data, and recommendations based on search criteria submitted by you.

Each Product is of a general nature only, will not take into account the potential impact of external factors over which we have no control (such as changes in the economy, future planned infrastructure, regulation, environment or the property market more broadly) and which may affect the Product’s accuracy or validity.

You undertake, represent and warrant that you will seek independent legal, financial and other professional advice before making any decision to purchase a property and will not rely on the information contained in the Product but will undertake your own analysis and assessment as to the value, viability and appropriateness of your proposed acquisition.

Advice warning

None of the information or content accessible from the Platform, including any Product, is intended to constitute a recommendation that any particular asset, investment or strategy is suitable for any specific person. None of the information, content or Products accessible from the Platform is, or is intended to be, personalised investment advice.

The information or content contained in or accessible from the Platform does not take into account the particular investment objectives, financial situation or needs of any individual or entity. User registration and accounts

You may need to create an account to access certain features of the Platform. You must provide accurate and complete information when creating your account, and you agree not to impersonate or misrepresent your affiliation with any person or entity.

The Platform or its Product(s) may contain links to other websites (Third-Party Websites), as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belong to, licensing from or originating from third parties (Third-Party Content). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Platform or any Third-Party Content posted on, available through, or installed via the Platform, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or Third-Party Content. You acknowledge that your access of or reliance on any Third-Party Websites and/or Third-Party Content is completely at your own risk.

Third-party contact consent

By accessing and using our Platform, you acknowledge and consent to the possibility of being contacted by third parties including but not limited to real estate agents & real estate professionals. These third parties may contact you through the Platform via the contact information you provide or that we collect specifically for this purpose and in accordance with our Privacy Policy, to offer their services, products, or information related to real estate available for purchase.

We are committed to safeguarding your privacy and protecting your personal information. By agreeing to these terms, you acknowledge we may share your name with third parties to facilitate contact. Under no circumstances shall we share other personal details, including but not limited to your email address, phone number, or any other personally identifiable information with third parties without your explicit consent.

To facilitate third party contact while protecting your privacy, we may provide a mechanism for users to receive communications from third parties without disclosing their personal details. This may include a secure messaging system or other features that allow users to communicate with third parties through the Platform while keeping their personal information confidential.

We strive to ensure that the third parties we work with are reputable and relevant to your interests, but we do not control the content or frequency of their communications. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information accessible via the Platform at any time, without prior notice.

Disclaimer of warranties

We do not warrant the accuracy or completeness of the information in the Product, and you acknowledge that the information in the Product is general in nature and current as at the date you acquire the Product (but not otherwise).

Limitation of liability and indemnity

We shall not be responsible for any loss, damage or expense, howsoever arising, whether direct or indirect and/or whether present, unascertained, future or contingent suffered by you or any third party, arising from or in connection with your use of our Platform and/or the Product.

By accessing the Platform or using the Product, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our Platform. This indemnity is a continuing obligation, independent from the other obligations under these Terms, and conditions after these Terms end.

You acknowledge that We reserve the right to vary any part of these Terms by posting updates to the relevant section of www.propfinder.com.au. It is your responsibility to check the relevant webpage periodically for changes. Your continued use of the Platform (or any products available from this Platform) following the posting of any changes to these terms constitutes acceptance of those changes.

Governing law

These Terms shall be governed by and construed in accordance with the laws of Victoria.
